1. Being a real estate consultant/service provider, we rely on the information obtained by the respective developer related to various projects through their representative/ advertisement/ electronic & print media or other such sources.
2. Clients/ users are advised to continually visit the website to see the amendment and keep them updated regarding events about the real estate industry.
3. The client must inform the company if the property booked by the client through our company is canceled. In such a condition, he should be liable to pay nominal charges for the issuance of no objection certificate.
4. The company is working as service provider can not be held responsible in case builder could not offer for possession as per schedule shared by the developer/ builder or the date provided to Real Estate Regulatory Authority or in the eventuality of any change made by the developer in layout/ change in super area/elevation or design, scraping of the project or any kind of change whatsoever in the policies.
5. The company being a service provider is not having any involvement in the decision making about projects or obtaining various statutory approvals from concerned authorities. The company entirely relies on the documents provided by the respective developer. It is not liable for any misrepresentation by the developer in any manner whatsoever.
6. The company will not entertain any verbal commitment made by any employee. The company will only consider written commitment on the company's letterhead created by the authorized person of the company. This is to clarify any written responsibility made by a person who is not empowered by the company will not be considered. Any commitment made by any employee through personal ID will not be considered by the company.
7. The clients have to abide by the rules and regulations of the concerned developer. In case the query of the client needs a response from da development, then our company will undoubtedly coordinate and give the best possible help. Still, the company will not be liable if the developer's response seems unsatisfactory to the client. The company further clarifies, if any interest is levied by the developer on overdue payment/ or cancel the unit under any circumstances whatsoever, the company will not be responsible for that in any case.
8. The company shall not be liable for any cancellation arising out of incomplete/ invalid documents/ non-section or delay in sanction of loan from any financial institution etc.
9. In the eventuality of any dispute on any matter whatsoever, the same shall be referred to an arbitrator appointed mutually by the company and client. In case of failure to nominate the mutually agreed Arbitrator, the same will be selected by a court of law following the provisions of the Arbitration and Conciliation Act. In case of dispute settlement in court, the courts at Greater Noida shall have the exclusive jurisdiction to try and entertain the same.
Each user shall indemnify, defend and hold harmless the company and its affiliates including directors, consultants, advisors, agent, and employees from and against all the direct claims, liabilities, costs, losses, damages, deficiencies, settlements, penalties, interest, fines, and expenses asserted against or incurred by indemnities that arise out of any breach or non-performance of any representation, covenant or obligations to be performed by such user under these general terms of use. Further, each user agrees to hold the indemnities harmless against any claim made by any third party due to or in connection with the ser's use of website or services.
